In the last few years the topic of innovation has often been compared with the organizational methods capable of favouring the transfer of knowledge between companies: in this context, the network model is becoming a useful and efficient instrument to favour the economic development of a territory. However, company networks have highlighted important problems in the doctrine related, on the one hand, to the most suitable governance forms to harmonise the interests of the companies involved in the various types of agreements; on the other hand, the institutional and norm related framework suitable to favour aggregation processes. This contribution, also through the support of empirical analyses, focuses its attention on legal aspects as well as economic and business aspects. All of this in the firm belief that a study based on the creation of company networks must be carried out on two different, yet complementary, levels: analysis of the legal forms and an examination of the essential features of the decision making processes that characterize aggregations between companies. I CURATORI Raffaele Trequattrini is full professor of Business Administration, Department of Economics and Law, University of Cassino and Southern Lazio (Italy), where he was appointed member of Board of Directors. He’s author of articles and monographs regarding accounting, corporate governance, knowledge economy and management of intangible assets. Giuseppe Recinto is full professor of Private Law, Department of Economics and Law, University of Cassino and Southern Lazio (Italy), where he was appointed member of the Academic Senate. He’s author of monographs, chapters in books, articles and case_law commentaries regarding contract law, law of obligations, arbitration, business, law of inheritance and minors. Giuseppe Russo is researcher and professor of Business Management, Department of Economics and Law, University of Cassino and Southern Lazio (Italy). He is Master Coordinator of I° level both in Social Enterprise Management and in Innovation and in Public Administration Management.
